The general Terms & Conditions of Sale detailed below govern the contractual relationship between the ‘User’ (hereafter also referred to as ‘You’ or the ‘Customer’) & ‘T E Shepherd Art & Illustration’ (hereafter also referred to as ‘We’, 'Our' or the ‘Website’), belonging to the business T E Shepherd Art & Illustration. Both parties accept these Conditions unreservedly. These General Conditions of Sale are the only conditions that are applicable & replace all other conditions, except in the case of express, written, prior dispensation. We maintain that, by confirming your order, you have read & do unreservedly accept our General Conditions of Sale. These Terms and Conditions of Sale are important to you and T E Shepherd Art & Illustration as they are used to protect your rights as a valued customer & our rights as a business.
Changes to the terms of service and the website
T E Shepherd Art & Illustration is an evolving brand and portfolio, and as such things may change, be added or be taken away. We reserve the right to update the Website & these Terms of Service from time to time, at our discretion & without any notice. It is solely your responsibility to keep up-to-date with the latest Terms and Conditions by checking back regularly. Your continued use of the Website following the publishing of updated Terms of Service will be taken to mean that you have read & agree to the changes.
Website access
While we endeavour to ensure that our website is normally available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time or for any period. Access to this website may be suspended temporarily & without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
Product information
All of Thomas's products are designed & manufactured in the UK.
Please be aware that all products may vary slightly in colour & appearance from the images on the website. At T E Shepherd Art & Illustration we take great care when putting product information, descriptions and images online but will not be held responsible for any mistakes or omissions to any information given. Items may also vary due to the organic nature of materials the products are created with & the nature of how colours appear on different electronic screens. You are always welcome to get in touch if you have any further queries or questions relating to any of Thomas's artworks or products through our contact page.
Prices
The prices indicated on T E Shepherd Art & Illustration are shown in Pound Sterling, unless you have specifically changed the currency, in which case prices are shown using the most up to date conversion rates (as determined by Shopify). The delivery costs are clearly shown & invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any time but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be canceled & the payment refunded to you, even if it has been initially validated. If ordering multiple items it is possible to request separate packaging, however, please note this is subject to an additional per item charge.
Availability
Due to the nature of many of the items sold on this website being handmade or ordered in relatively small quantities from local suppliers, shipping times may vary. Please see the delivery section for delivery estimates. If a product should become unavailable after your order has been confirmed & paid for, we will contact you personally immediately & offer to refund the price you paid for the product within 30 days following the date of payment. If your order includes products that are temporarily unavailable, we can offer the option to send the available products out first & will follow with the outstanding items once they are available again. You of course will not be charged shipping fees for the rest of the order. If relevant, we can offer you a replacement for an unavailable product, such as a product of equal price and quality. If you accept the replacement and then wish to return it to us in the conditions outlined under 'Return & Refunds', the return postage will be covered by us. If you choose to decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product. Please note if your order is required for an event such as birthday or wedding that will occur within the next 7 days please contact us prior to ordering to so that we can ensure you will receive your order on time your event.
Secure payment
T E Shepherd Art & Illustration currently offers multiple ways to pay for your order, PayPal or Credit/Debit Card. These payment options use advanced SSL encryption to keep your transaction secure and do not cost you anything to use (T E Shepherd Art & Illustration is charged as the seller, you are not charged as the buyer) so you will not pay any extra for your order. You do not need to hold an account with these Merchants to use these methods of payments. Please refer to PayPal for full terms and conditions of use.
Commissions
Commissioned artwork and bespoke stationery cannot be returned once they have been completed and paid for. Payment for commissions and bespoke stationery must be completed, plus payment for postage and packaging, before they are posted.
Intellectual ownership
All the website & social media content at T E Shepherd Art & Illustration (illustrations, artworks, designs, texts, names, brand names, images and videos), excluding manufacturer supplied descriptions, illustrations and image is the property of T E Shepherd Art & Illustration. Any partial or total reproduction of this content, along with any commercial reselling of any products or designs (online and offline), by any means and on any support, is subject to prior and express authorisation by T E Shepherd Art & Illustration. All information, content and files is protected by international law concerning intellectual ownership and copyright. T E Shepherd Art & Illustration cannot give you the right to copy, display or distribute content to which you do not have the intellectual rights. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.
T E Shepherd Art & Illustration will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.
